The new statistics have been published for the number of fatally injured workers by the Health and Safety Executive. The figures were released on July 5th and cover the period between April 2011 and March 2012. The statistics show that 173 workers were killed, which is two less than the previous year’s data. Two eighteen year old workers were seriously injured after falling from a lifting platform. The two men were hired by Storetec Ltd to remove scrapped trolleys and place them in a skip using a forklift truck. The director had designed a lifting platform which was being used by the men to perform the task they had been set. Unfortunately the platform failed bringing the fork lift truck and the two men down to the ground, four and half metres below.

In the incident one of the men broke his back and the other suffered broken heels and has needed metal pins to be placed in his foot. They have both suffered with serious physical and physiological problems since the incident and their lives have been permanently affected.

Large Fines for Failing Employees

The company and one of the directors of the firm were prosecuted by the Health and Safety Executive after an investigation was carried out. The inspectors discovered that the lifting platform had been designed by the director, Brian Crossan, who didn’t follow the strict guidelines and safety laws when he made the makeshift platform. There were numerous errors found such as the lack of chains securing the plate to the fork lift truck and the fork extensions not fitting onto the platform.

Storetec were fined £22,000 after breaching Section 3(1) of the Health and Safety at Work Act. They were also ordered to pay £12,134 in court costs. Mr Crossan was also fined £3,500 after pleading guilty for failing to comply with the Lifting Operations and Lifting Equipment Regulations. He must also pay £7,866 in court costs. Both the company and the director had to pay a victim surcharge of £15.

Workmen who were working on a pub in Devon were needlessly exposed to deadly asbestos dust. Not only were they exposed to it their site manager also gave the instruction for them to deal with removing it from the pub and did not provide adequate protection. The incident occurred in 2010 at a pub which was being refurbished by Cowley’s Building Maintenance who on behalf of St Austell Breweries.

Work Told to Continue

The workers were working with the deadly material as there had been no asbestos survey which was the responsibility of St Austell Breweries. The men were given the task of removing uncovered insulation boards which contained asbestos. While the site manager did request for the board to be examined he did make his workers continue to pick up the boards and remove them. Throughout the demolition more asbestos boards were moved and disturbed which increased the exposure levels for the workers.

As a result of the incident St Austell Breweries were fined £5,000 and ordered to pay court costs of £6,295 in court costs. Cowley’s Building and Maintenance were also fined £12,500 with £6,295 in costs. The director of the company was additionally fined a total of £4,500 including costs and the fine. The Brewery pleaded guilty for breaching Regulation 4(3) of the Control of Asbestos Regulations. Cowley Building and Maintenance and Mr Reed pleaded guilty to breaching Regulation 11(1) (a) of the Control of Asbestos Regulations.

Mark Bale was just 21 when he was instantly killed after being crushed by a loader. He was not provided with any training when using the vehicle, and there was no one supervising him as he worked. In addition to these failings the vehicle that the young man was operating had not been properly maintained.

SITA UK pleaded guilty at Wolverhampton Crown Court. They were fined £100,000 and ordered to pay court costs of £77,402 plus an additional payment to the mother of the deceased for the costs of the funeral.
